These Terms and Conditions (the “Terms”) govern your access to and use of ashandnectar.com and any related webpages, features, content, and services (collectively, the “Site”), as well as purchases made through the Site. The Site is operated by Akoma Enterprises of Texas LLC, doing business as Ash & Nectar (“Ash & Nectar,” “we,” “us,” or “our”).
By visiting the Site, creating an account, or placing an order, you agree to these Terms and our Privacy Policy, Shipping Policy, and Refund and Return Policy. If you do not agree, do not use the Site or purchase our products.
You must be at least 21 years old to access, purchase, possess, or use any product containing hemp-derived cannabinoids. Delivery estimates are not guarantees. We are not responsible for delays caused by carriers, weather, incorrect addresses, access problems, legal restrictions, or events outside our reasonable control. Title and risk of loss pass to you when permitted by applicable law and as described in our Shipping Policy.
Do not forward, reship, or transport a cannabinoid product into a jurisdiction where it is prohibited.

If you submit a review, photo, comment, recipe, testimonial, or other content, you represent that it is truthful, based on your genuine experience, does not violate law or third-party rights, and does not contain medical or disease-treatment claims.
You grant Ash & Nectar a nonexclusive, worldwide, royalty-free, sublicensable license to use, reproduce, edit, publish, display, and distribute submitted content in connection with our business and marketing, subject to applicable law and our Privacy Policy. We may remove or decline to publish content at our discretion. We will disclose material connections where required.
The Site may contain links to or integrations with third-party websites, payment processors, shipping carriers, social platforms, or other services. TO THE MAXIMUM EXTENT PERMITTED BY LAW, ASH & NECTAR AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM OR RELATED TO THE SITE OR PRODUCTS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR A CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID TO ASH & NECTAR FOR THE PRODUCT OR ORDER GIVING RISE TO THE CLAIM. THESE LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT LAWFULLY BE LIMITED OR EXCLUDED.
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Ash & Nectar and its owners, officers, employees, contractors, and agents from claims, losses, liabilities, damages, and reasonable expenses arising from your unlawful use of the Site or products, your violation of these Terms, or your infringement of another person’s rights.
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any dispute that is not resolved informally shall be brought in a state or federal court with jurisdiction in Dallas County, Texas, and you consent to that venue, except where applicable law gives you a non-waivable right to bring a claim elsewhere.
Before filing a claim, you and Ash & Nectar agree to make a good-faith effort to resolve the dispute by written notice and informal discussion for at least 30 days.
We may update these Terms to reflect changes in our practices, products, technology, or legal obligations. Updated Terms will be posted on this page with a revised effective date. Changes apply prospectively when posted unless a different date is stated or applicable law requires otherwise. Your continued use of the Site after the effective date means you accept the updated Terms.
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect, and the unenforceable provision will be enforced to the greatest extent permitted by law. Our failure to enforce a provision is not a waiver. You may not assign your rights or obligations under these Terms without our written consent. We may assign these Terms in connection with a merger, reorganization, sale of assets, or transfer of the business.
